Do You Need a Permit to Build a Pool in Houston?
Yes. The Houston Permitting Center lists a Swimming Pool Permit for the construction of a new swimming pool at a residence or commercial building, issued by Houston Public Works Structural Inspections under Chapter 43 of the City Code, and a separate Health Department plan review that is required for the construction of a residential pool in a single-family home or duplex. Both plan reviews run before the permit issues, and both departments inspect: Structural reviews residential plans in the field, and the Health Department approves on Structural's sign-off. The city's definition of a swimming pool is any structure capable of holding water for swimming or bathing with a depth of more than 18 inches, at ground level, above ground or indoors. The Health Department review is explicitly not for above-ground pools or spas, so an above-ground pool skips that fee; ask Structural Inspections whether the building permit applies to yours, and remember that the pump circuit always needs an electrical permit.

How Much Does a Pool Permit Cost in Houston?
Two city charges are fixed and published. The Health Department's residential pool plan review is $94.00 plus the $33.56 administrative fee, $127.56, with a 10-business-day processing time. The Structural Swimming Pool Permit carries its own $33.56 administrative fee and a permit fee taken from the city fee schedule; the 2026 schedule has no line item named for pools, and its structural minimum permit fee is $91.06, so the permit is at least $124.62 and the two filings together at least about $252. The pool equipment adds an electrical permit at the $91.06 minimum plus $33.56 admin, and a gas heater adds a gas permit at $45.53 for up to four openings under the $97.56 plumbing minimum plus admin, which is how a typical in-ground pool lands near $500 in city fees. Plans for a building permit also carry a non-refundable plan review fee of 25 percent of the estimated permit fee. The pool contractor's price, the survey and any engineering are separate. Houston Pool Fence and Gate Rules
The Health Department's plan requirements ask for the complete enclosure around the pool to be highlighted on the plot survey, with each type and height of fence and gate labeled. City Code Section 43-33 mandates that all gates be self-closing and self-latching, closing and latching without human or electrical power after opening. Enclosures must be separate from driveways: gates that cut across driveways are prohibited, driveway gates and carports cannot serve as part of the enclosure, and driveways, garages and carports must sit outside the pool fence. Fence and gate details are drawn per material, and ladder effects or features that aid climbing are not approved.
